We warrant that goods of our own manufacture, excluding customized software/firmware, are free from defects in material workmanship and conform to our published specifications in all material respects for a period of 90 days from data of delivery. Goods found not conforming to this warranty and returned to us withing the applicable warranty period will be eligible for replacement, repair, or credit. This warranty will not apply (i) in cases where goods have suffered misuse, abuse, neglect, alteration, accident, mishandling, repair, operation outside of associated environmental specifications, improper installation, improper testing or the like after shipment (collectively a “Disqualifying Event”); (ii) where Goods are designated as experimental or to be used for development purposes; (iii) to Goods not manufactured by us or a related company; (iv) to Goods for which claims are being made by anyone other than you; or (v) to the extent that the defect was caused by using Goods despite them failing your tests. Our giving you technical assistance will not expand this limited warranty. This limited warranty does not apply to any goods or equipment within which Goods are contained or integrated.
To obtain a remedy for Goods failing to meet the foregoing warranty, the following conditions must be met: (i) you must notify us in writing promptly on the discovery of the deficiency in reasonable detail within the warranty period; (ii) you must return Goods to our plant promptly on receipt of our RMA number, and your risk and expense; and (iii) we confirm the claimed deficiency is present and find it is not attributable to a Disqualifying Event. If all of these conditions are met, we will either replace or repair the deficient Goods, or credit your account for the amount you paid us for them, at our option, and, we will reimburse your reasonable transportation costs for return of Goods. This constitutes your sole and exclusive remedy for breach of our Goods warranty, and we will have a reasonable time to provide the remedy.
